1. Agreement to Terms
By accessing and using BiggMate, you agree to be bound by these Terms of Use. If you disagree with any part of these terms, you may not use our Service. BiggMate reserves the right to modify these terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of BiggMate following the posting of changes constitutes your acceptance of such changes.
2. Eligibility
To use BiggMate, you must: • Be at least 18 years of age • Have the legal capacity to enter into binding contracts • Not be prohibited from using BiggMate under applicable laws • Not be on any government sanctions lists • Agree not to use BiggMate for any illegal or unauthorized purposes We reserve the right to verify your eligibility at any time. If we determine you do not meet these requirements, we may suspend or terminate your account.
3. Account Registration and Security
When you create an account, you agree to: • Provide accurate, current, and complete information • Maintain the confidentiality of your password • Accept responsibility for all activities that occur under your account • Promptly notify us of unauthorized access or use • Keep your profile information up-to-date BiggMate is not liable for any loss or damage from unauthorized access to your account. You are solely responsible for maintaining account security.
4. Acceptable Use Policy
You agree not to use BiggMate for: • Illegal activities or violation of any laws or regulations • Harassment, abuse, or threatening behavior toward other users • Posting false, misleading, or fraudulent information • Spamming, phishing, or sending unsolicited messages • Intellectual property infringement • Posting adult content, pornography, or offensive material • Soliciting money, personal information, or financial services improperly • Operating bots or automated systems without permission • Circumventing security or authentication mechanisms • Violating others' privacy or impersonating others Violations may result in account suspension or termination without refund.
5. User Content and Rights
When you post content (profile information, messages, pitches, documents), you: • Grant BiggMate a non-exclusive, royalty-free license to use, modify, and distribute your content for platform operations • Retain ownership of your content • Represent that you own all rights to your content and have permission to post it • Acknowledge that your profile content is visible to other BiggMate users • Warrant that your content does not infringe third-party rights BiggMate may delete any content that violates these terms or applicable laws. You are responsible for backing up your content.
6. Intellectual Property Rights
BiggMate and all its content, features, and functionality (including but not limited to software, logos, text, and graphics) are owned by BiggMate or its licensors. You agree not to: • Modify, copy, or reproduce any part of BiggMate without permission • Reverse engineer or attempt to discover source code • Remove or alter copyright, trademark, or other proprietary notices • Use BiggMate for commercial purposes without authorization • Create derivative works based on BiggMate Unauthorized use of BiggMate's intellectual property may result in legal action.
7. Third-Party Services and Links
BiggMate may contain links to third-party websites and services. We do not endorse, control, or assume responsibility for third-party content, services, or privacy practices. Your use of third-party services is at your own risk and subject to their terms and conditions. BiggMate is not liable for any damage or loss resulting from your use of third-party services.
8. Disclaimer of Warranties
BiggMate is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to: • Merchantability and fitness for a particular purpose • Non-infringement of third-party rights • Accuracy, completeness, and timeliness of information We do not warrant that BiggMate will be uninterrupted, error-free, or secure. Use of BiggMate is at your own risk. We are not responsible for any damages resulting from access to, use of, or inability to use BiggMate.
9. Limitation of Liability
To the fullest extent permitted by law, BiggMate shall not be liable for: • Indirect, incidental, special, consequential, or punitive damages • Loss of profits, revenue, data, or business opportunities • Damages arising from unauthorized access to your account • Damages resulting from your breach of these terms • Any other damages, even if advised of their possibility This limitation applies regardless of the legal theory (contract, tort, negligence, etc.). Some jurisdictions do not allow limitation of liability, so this may not apply to you.
10. Indemnification
You agree to indemnify, defend, and hold harmless BiggMate and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: • Your violation of these Terms of Use • Your use of BiggMate in violation of applicable laws • Your user content or submissions • Your infringement of third-party rights • Your interactions with other users You agree to cooperate fully with BiggMate in defending any claims subject to indemnification.
11. Termination
BiggMate may terminate or suspend your account immediately, without prior notice or liability, for: • Violation of these Terms of Use • Illegal or harmful behavior • Fraud or misrepresentation • Repeated violations of our Acceptable Use Policy • Any other reason at BiggMate's sole discretion Upon termination, your right to use BiggMate ceases immediately. BiggMate is not liable for any consequences of account termination. You remain liable for any obligations incurred before termination.
12. Payment and Billing (If Applicable)
If you purchase premium features or services through BiggMate: • You authorize us to charge your payment method • You agree to pay all charges incurred • Billing will continue until you cancel • Refunds are subject to our refund policy • Prices may change with 30 days' notice • You are responsible for currency conversions Unauthorized payment attempts or fraud may result in account suspension and legal action.
13. Dispute Resolution
Any disputes arising from these Terms of Use or your use of BiggMate shall be resolved through: 1. Good Faith Negotiation: Parties will attempt informal resolution for 30 days 2. Binding Arbitration: If unresolved, disputes will be arbitrated per applicable law 3. Class Action Waiver: You waive the right to bring claims on a class-action basis 4. Governing Law: These terms are governed by applicable jurisdiction laws Arbitration will be conducted in English, with each party bearing its own costs unless required otherwise.
14. Severability
If any provision of these Terms of Use is found to be invalid or unenforceable, that provision will be severed, and the remaining provisions will remain in full force and effect. If necessary, we will modify the invalid provision to make it valid while preserving its original intent.
15. Entire Agreement
These Terms of Use, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and BiggMate regarding your use of the Service. These terms supersede all prior agreements, understandings, and communications, whether written or oral.
